This End User License Agreement ("EULA") is a legal agreement between you ("Licensee") and FAVZ Group ("AIZA") for the use of the AIZA-Hextyx scan engine, command-line interface (CLI), API client libraries, and any associated software components (collectively, the "Software").
This EULA applies specifically to downloaded or locally deployed Software. If you access AIZA solely through the hosted web platform at hextyx.com, the Terms of Service govern your use and this EULA does not independently apply (though it is incorporated by reference in the Terms of Service).
By downloading, installing, or using the Software, you agree to be bound by this EULA.
Subject to the terms of this EULA and your active subscription, AIZA grants you a limited, non-exclusive, non-transferable, revocable license to:
You may not:
3.1 Distribution - Redistribute, sell, resell, sublicense, or transfer the Software or any component of it to any third party without AIZA's express written consent - Include the Software in a product or service that you offer to third parties without an appropriate Enterprise or Reseller license from AIZA
3.2 Modification and Reverse Engineering - Modify, adapt, translate, or create derivative works based on the Software - Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, scan methodologies, detection algorithms, or PoE marker system from the Software - Remove, alter, or obscure any proprietary notices, labels, or marks on the Software
3.3 Misuse - Use the Software for any purpose prohibited by the Acceptable Use Policy - Use the Software to scan systems without proper authorization - Use the Software's methodologies, payloads, or detection techniques outside the Software itself
3.4 Competitive Use - Use the Software, its outputs, or information derived from it to build a competing product or service - Benchmark the Software against competing products for commercial publication without AIZA's consent
The Software is licensed, not sold. AIZA and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. Nothing in this EULA transfers any ownership of the Software to you.
AIZA may release updates, patches, or new versions of the Software. Updates may be:
AIZA reserves the right to end support for specific versions with ninety (90) days advance notice. After end-of-support, AIZA has no obligation to provide security patches or bug fixes for that version.
The Software may collect anonymous usage telemetry including: - Scan phase configurations (which phases are enabled/disabled) - Scan completion status (success/failure — not findings content) - Software version and operating environment - Error and crash reports
This telemetry is used to improve the Software and does not include scan results, target URLs, or identifying information. You may disable telemetry via configuration settings. For details, see our Privacy Policy.
The Software incorporates open source components governed by their respective licenses. A complete list is available in the Software's documentation (LICENSES.md or equivalent). Where open source licenses impose obligations on redistributors, those obligations apply to redistributors, not to end users using the Software internally.
The Software may interact with third-party services (Supabase, Railway, external AI APIs). Your use of those services is subject to their respective terms of service. AIZA is not responsible for the availability or terms of third-party services.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIZA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIZA'S LIABILITY UNDER THIS EULA SHALL NOT EXCEED THE FEES PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. AIZA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
This EULA is effective from the date you install or use the Software and continues until terminated.
You may terminate this EULA by ceasing all use of the Software and deleting all copies from your systems.
AIZA may terminate this EULA immediately upon written notice if you breach any material term and fail to cure the breach within fifteen (15) days of notice.
Upon termination: - Your license to use the Software ends immediately - You must delete all copies of the Software from your systems - Sections 4, 9, 10, 11.4, and 12 survive termination
Entire Agreement: This EULA, together with the Terms of Service and Acceptable Use Policy, constitutes the entire agreement between you and AIZA regarding the Software.
Governing Law: This EULA is governed by the laws of Wyoming, USA.
Export Compliance: You agree to comply with all applicable export control laws and regulations. The Software may not be exported or re-exported to embargoed countries or to persons on restricted party lists.
Government Users: If you are a US government entity, the Software is commercial computer software subject to restricted rights as described in FAR 52.227-19 or DFARS 227.7202.
